Privacy Policy

Effective and last updated: September 17, 2026

BRIXEN LLC is organized and based in Utah. This Policy is structured around applicable Utah and federal requirements, including the Utah Consumer Privacy Act where it applies. Because BRIXEN may serve customers outside Utah, we also honor any additional nonwaivable privacy rights required by the law of a customer’s state.

1. Scope and controller

BRIXEN LLC (“BRIXEN,” “we,” “us,” or “our”) is a Utah limited liability company and is responsible for the personal information described in this Policy. This Policy covers our website, ecommerce and rewards activity, product communications, customer support, and related social-media interactions. Independent third-party websites and services are governed by their own notices.

Utah law is the primary governing framework for BRIXEN’s operations. References to rights available in other states apply only when BRIXEN’s activities and the consumer meet that state law’s applicable scope and thresholds, or when BRIXEN voluntarily honors the request.

2. Information we collect

Information you provide

  • Identifiers and contact information, such as name, email, phone number, shipping and billing address.
  • Account, order, transaction, payment-status, returns, rewards, and customer-service records. Payment-card details are generally processed by payment providers rather than stored directly by BRIXEN.
  • Marketing preferences and consent records for email or SMS.
  • Communications, reviews, photographs, survey responses, promotion entries, and other content you submit.
  • Product preferences or information you voluntarily share about allergies, sensitivities, skin or lip concerns, or reactions. See our Consumer Health Data Privacy Policy.

Information collected automatically

  • Device and network information, including IP address, browser, operating system, device identifiers, and approximate location derived from IP.
  • Website activity, such as pages viewed, links selected, referring pages, timestamps, cart activity, and interactions with emails or advertisements.
  • Cookies, pixels, local storage, and similar technologies used for essential operation, preferences, analytics, security, and—if enabled—advertising.

Information from other sources

We may receive information from ecommerce and payment providers, shipping carriers, fraud-prevention services, marketing platforms, social networks when you interact with us, analytics providers, business partners, and publicly available sources.

3. How we use information

  • Operate, secure, troubleshoot, personalize, and improve the website and products.
  • Process payments, orders, delivery, returns, rewards, accounts, and customer-service requests.
  • Send transactional messages and, with required consent, marketing email or text messages.
  • Measure performance, understand customer interests, conduct analytics, and develop products.
  • Detect fraud, abuse, security incidents, or unlawful conduct and enforce our agreements.
  • Comply with law, legal process, tax and accounting duties, and protect rights and safety.
  • Carry out another purpose disclosed when information is collected or with your consent.

Where a law requires a legal basis, we rely on contract, consent, legitimate interests, and legal obligations as applicable.

4. How we disclose information

We may disclose personal information to the following categories of recipients for the purposes above:

  • Vendors and processors supporting website hosting, ecommerce, payments, fraud prevention, customer support, analytics, email/SMS, advertising, fulfillment, shipping, accounting, and professional services.
  • Carriers, payment networks, and transaction partners needed to complete a requested purchase.
  • Government authorities, courts, regulators, or other parties when reasonably necessary to comply with law or protect rights, safety, and security.
  • A buyer, lender, advisor, or successor in connection with financing, reorganization, merger, acquisition, bankruptcy, or sale of assets, subject to applicable law.
  • Other parties at your direction or with your consent.

BRIXEN does not sell personal information for money. If BRIXEN later uses advertising technology that constitutes “selling,” “sharing,” or targeted advertising under applicable law, this Policy and the Your Privacy Choices page will be updated and required opt-outs will be provided before that use.

5. Cookies and online signals

We and providers may use cookies and similar technologies for essential functions, preferences, security, measurement, and permitted marketing. Browser controls may block or delete these technologies, but parts of the website may not work correctly. Because legal standards for browser “Do Not Track” signals are not uniform, we do not respond to DNT signals. We honor legally required opt-out preference signals, such as Global Privacy Control, when applicable to our processing.

6. Your choices and privacy rights

You may unsubscribe from marketing email using the link in a message and opt out of marketing texts by replying STOP. Transactional messages may continue. Depending on where you live and subject to legal exceptions, you may have rights to know or access, correct, delete, obtain a portable copy, opt out of certain sale, sharing, targeted advertising, or profiling, limit certain sensitive-information uses, withdraw consent, and appeal a denied request.

Visit Your Privacy Choices or email info@brixenx.com with “Privacy Request” in the subject. Describe your request and state of residence. We may verify identity and authority before acting. Authorized agents may submit requests where permitted, but we may request proof of authorization and direct verification. We will not discriminate against you for exercising a privacy right.

7. Retention

We retain information only as reasonably necessary for the purposes described, including providing services, maintaining transaction and consent records, resolving disputes, preventing fraud, enforcing agreements, and meeting tax, accounting, safety, and legal requirements. Retention varies by information type, relationship, legal obligation, and operational need. We may deidentify information and retain it where permitted by law.

8. Security

We use reasonable administrative, technical, and physical safeguards designed for the nature of the information. No system or transmission is completely secure, and we cannot guarantee absolute security. You are responsible for using unique credentials and protecting access to your devices and accounts.

9. Children

The website is not directed to children under 13, and BRIXEN does not knowingly collect personal information from children under 13. If you believe a child submitted information, contact us so we can review and delete it as required. We do not knowingly sell or share personal information of consumers under 16.

10. U.S. processing and third-party links

BRIXEN is based in the United States. Information may be processed in the United States and other locations where providers operate, subject to applicable safeguards. Third-party links and services have independent privacy practices; review their notices before providing information.

11. Changes to this Policy

We may update this Policy as practices or law change. We will post the revised date and provide additional notice or obtain consent when required. Materially different uses of previously collected information will be handled as required by law.
